Terms of Service
Effective Date: January 1, 2026
1. Acceptance & Governing Law
By accessing or using Culinote.app (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms are governed by the laws of Belgium. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Belgium.
2. Membership & Billing
Culinote.app offers subscription plans (SOLO, COUPLE, FAMILY) with monthly and yearly billing cycles. By subscribing, you agree to pay the fees associated with your chosen plan.
Automatic Renewal: Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. It is your responsibility to cancel your subscription if you do not wish to continue.
Express Waiver of Right of Withdrawal: By purchasing a subscription and receiving immediate access to the Service, you expressly request that we begin providing the Service immediately. You acknowledge that by receiving immediate access, you lose your statutory 14-day right of withdrawal for the initial purchase under EU consumer law.
3. Cancellation & Refunds
Cancellation: You may cancel your subscription at any time. Your access to the Service will continue until the end of your current paid billing period. No refunds will be provided for partial months or years.
Voluntary 7-Day Satisfaction Guarantee: As a gesture of goodwill, we offer a voluntary 7-day satisfaction guarantee. If you are not satisfied with the Service within 7 days of your initial purchase, you may request a refund by contacting support@culinote.app. This guarantee is separate from any statutory rights and applies only to the initial purchase.
4. User-Generated Content (UGC)
Ownership: You retain all ownership and copyright to the recipes, meal plans, and shopping lists you create and input into the Service ("User Content").
License Grant: By using the Service, you grant Culinote.app a non-exclusive, royalty-free, worldwide, transferable license to host, display, reproduce, and use your User Content solely for the purpose of operating the Service for you and your invited family/couple members.
Sharing with Invited Members: If you are on a COUPLE or FAMILY plan and invite other users to your membership, you automatically grant those members access and a limited license to view and use your recipes for the term of their membership.
5. App Use & User Responsibilities
You agree to use the Service in accordance with your subscription plan limits (SOLO, COUPLE, or FAMILY) and in compliance with all applicable laws and regulations.
Prohibited Conduct: You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Attempt to scrape, copy, or extract data from the Service
- Share your account credentials with unauthorized users
- Interfere with or disrupt the Service or servers
- Use automated systems to access the Service without authorization
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
CRITICAL RECIPE SAFETY DISCLAIMER: Culinote.app is a tool for organizing recipes and meal plans. We do NOT warrant or guarantee:
- The accuracy, safety, or nutritional value of any user-entered recipe
- The accuracy of any allergenic information
- The fitness for consumption of any recipe or generated shopping list
- The safety of any food preparation methods described
YOU ARE SOLELY RESPONSIBLE for verifying all recipe details, ingredients, allergies, and ensuring proper food safety practices. Always follow safe food handling and preparation guidelines.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CULINOTE.APP'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF:
- €100 EUR, or
- The total amount you paid to Culinote.app in the 6 months immediately preceding the event giving rise to the claim
CULINOTE.APP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION.
8. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. Please review our Privacy Policy at /privacy.
Minimum Age: The Service is not intended for children under 13 years of age. If you are between 13 and 16 years old, you affirm that you have the consent of a parent or legal guardian to use the Service and agree to these Terms.
9. Service Level Agreement (SLA)
While we strive for 100% uptime, we do not guarantee uninterrupted access to the Service. Our target uptime is 99.9% availability per calendar month (approximately 43 minutes of downtime per month).
The following do not count as "downtime":
- Scheduled maintenance with advance notice (typically 24 hours)
- Force majeure events beyond our reasonable control (natural disasters, major internet outages, etc.)
- Downtime caused by your internet connection or devices
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Effective Date" at the top. Your continued use of the Service after such changes constitutes your acceptance of the modified Terms.
